Tribe threatens to occupy disputed Boracay land

t’s not only the heat that sizzling in Boracay. A land dispute between the indigenous people of Aklan and some businessmen is about to boil over.
Members of the Ati tribe are now threatening to occupy the two-hectare beach property earlier awarded to them, even without a government order installing them on the land, to protect it from further development by the other rich claimants.

“We’re following the due process. And yet this due process is giving undue advantage to the rich claimants who continue to build structures. We might end up without a land of our own,” Delsa Justo, chieftain of the Boracay Ati Tribal Organization, said in an interview.

The tribespeople are racing against time to get hold of the property located in Barangay Manoc-Manoc on the southern tip of the 1,032-hectare island-resort before it’s allegedly gobbled up by the structures put up by the Banico, Sanson and Gelito families.

The National Commission on Indigenous Peoples (NCIP) is set to issue a resolution to finally settle the dispute in a few days, but this won’t be immediately enforceable. The other claimants can still appeal within 15 days after receiving the order.

A lot of things could happen in 15 days, and if the order is unfavorable to them, the other claimants could bring the case to the Court of Appeals, and the Supreme Court. By the time it’s finally resolved, there would be nothing left of the property, the Atis said.

So their option now is to occupy the property and protect it, they said.

Meantime, President Aquino should follow up on the NCIP’s award of the Certificate of Ancestral Domain Title given to the Atis in January 2011, and take up their case, said Justo, who traveled to Manila in the hope of getting the installation order from the NCIP.

Justo, together with four other tribe members, Sr. Hermina Sutarez and Jose Antonio Morillo, was told by the NCIP en banc on Friday morning that the resolution won’t be issued until next week, but this won’t be enforceable until after the other claimants had seen and commented on it.

The other claimants had filed motions canceling the title issued to the Ati with the NCIP and the regional trial court in Kalibo, showing deeds of sale as proof of their ownership of the property. With the row still unresolved, the Atis are staying in a one-hectare property that is also being claimed by politicians in Bgy. Balabag.

Anthropologists said the Atis had inhabited the island long before the earliest Visayan migrants came. By the 1970s, tourists began streaming into the island, famed for its powdery white sand beaches and crystalline waters.

Casino near Boracay?

MANILA, Philippines - Buruanga, a town near Boracay in Aklan province, is currently in talks with a private stakeholder for the possible establishment of a casino operation as added tourism lure in the area.

The Catholic church hierarchy had already started expressing opposition to the project being pushed by the local government. Initially, the Catholic hierarchy received reports that the casino operation would be established near the Church.

But the local government immediately denied the report saying that the sites being considered for the casino operation is somewhere near the beach.

Currently, Buruanga Mayor Quezon Labindao is in Metro Manila.

Buruanga town is just a few kilometers away from Boracay considered as one of the best beaches in the world.

Aklan ready for 1-M tourists in 2012

BORACAY ISLAND, Aklan, Feb. 15 — Aklan Governor Carlito Marquez urged the stakeholders in this resort island to work hand-in-hand as the province expects to realize the one million tourist visitors by the yearend.

Data from the provincial tourism office showed that for January alone, Boracay posted 110,000 tourist arrivals, making the Aklan government confident of reaching its one million target.

In 2011, the provincial government recorded 910,000 tourist arrivals composed of both foreign and local tourists.

Sources from the Boracay stakeholders said that there are around 8,000 rooms in Boracay. Only 90 percent are being filled up however because each resort must reserve a vacant room for their visitors in case there would be unexpected technical problems.
To address such, some large hotels in this resort island continue to add more rooms to cope with the demand for tourists coming to this resort island.

According to the Department of Tourism, 2011 was another banner year for Boracay, as it registered close to 910,000 visitors. This represents a 16% increase from the previous year. Aklan’s provincial government expects Boracay to hit the one million mark by the end of this year, a target previously set for 2013.

Thousands of small "pyramids" are being planted off the resort island of Boracay in an effort to bring its nearly destroyed coral reefs back to life, an environment group said Thursday.

Over 300 of the structures were planted this week off Boracay's coast and eventually about 5,000 will be placed in the sea, according to Sangkalikasan (Nature) which is behind the effort.

"This is like putting garden soil for ideal growth on land. We are doing the same concept in the sea," Jose Rodriguez, vice chairman of the group, told AFP.

Boracay, famed for its stunning white sand beach and clear waters, is one of the Philippines' top tourist destinations with nearly one million people visiting the island last year.

But unsustainable development and the ever-growing number of tourists have caused severe environmental problems, including the destruction of the nearby reefs which often leave snorkellers looking at grey coral and few fish.

"My family has been coming to the island since the 1980s and we do see the drastic difference... (now) you only find the rubble of coral," Rodriguez said.

He said divers had been planting the pyramid-shaped structures, called "reefbuds", in about 7-9 meters (23-30 feet) of water up to 1,200 meters out to sea, and hoped to have all 5,000 in place in four months.

The reefbuds, which are about 70 centimeters (27 inches) tall, are not mere artificial reefs but will also serve as a medium for coral to grow back, according to Rodriguez.

Made of a combination of concrete, agricultural products and seawater, the hollow pyramids will initially serve as a breeding ground for algae and small fish.

But their porous walls are designed to allow coral to take root as well, so eventually they will give rise to an actual reef, said Sangkalikasan technical consultant Benjamin Tayag.

"You will first have soft corals, then hard corals but this will take years. Some hard corals grow only one centimeter a year," he said.

The areas where the reefbuds are being planted will be declared off-limits to jet skis, boats that drop anchor and other forms of recreation that led to the initial damage, according to Tayag.

SC stops P1-B Boracay reclamation project

(Updated 3:30 p.m.) The Supreme Court on Tuesday issued an order temporarily stopping the Aklan government from proceeding with its P1-billion reclamation project off Boracay Island.

In its en banc session, the magistrates voted to issue a temporary environmental protection order against the construction of a 40-hectare reclamation site between Boracay Island and the coastal village of Caticlan.

“The respondents are being ordered to cease and desist from conducting reclamation activities along the coastlines in Caticlan in Malay, Aklan," Supreme Court spokesman and administrator Jose Midas Marquez said at a news briefing.

The Aklan government is given 10 days to file its comment, Marquez added.

The reclamation project being questioned has two components: 36.82 hectares on Caticlan in mainland Aklan, and 3.18 hectares on Boracay Island. Caticlan and Boracay are located in Malay town in Aklan province.
